Investor Declaration

I, [name], after registering with an internet-based platform on www.lendbox.in/perannum (hereinafter referred to as “The Website”), to find suitable borrower(s), do hereby declare as follows:

1. I have read all the material, terms and conditions available on the website of M/s. Transactree Technologies Private Limited (hereinafter referred to as “The Company”), owners and operators of the Website.
2. I have unconditionally agreed to abide by the terms and conditions, Privacy Policy, Fair Practices, RBI disclaimer, and other binding material contained on the Company’s website.
3. The information and financial details furnished by me on the Company’s website are true and correct, and nothing material has been withheld.
4. I have agreed to lend to independent borrower(s) through the Company on my own volition, and I understand that the Company is only a market platform/digital aggregator for persons interested in availing and granting loans. The Company does not intervene or engage directly or indirectly in any loan transaction, and I have to deal directly with the borrower(s).
5. I have not made any decision solely based on the information available on the Website. In the event of any dispute with the borrower(s), the resolution shall be directly between the borrower(s) and me, and the Company or any representative of the Company shall not be involved.
6. My registration on the Website does not make the Company a party or privy to the loan transaction(s). The Company or any representative shall not be held responsible for repayment of the loan(s), loss of money, failure to recover the money, or breach of any confidential information arising from the loan transaction(s).
7. I have registered on the Website on my own volition and understand that the Company is not responsible for any inaccuracy or material accessed by me on the Website.
8. I have an active bank account with a scheduled commercial bank licensed by the RBI. I shall disburse the loan(s) from this bank account or as designated by me. I have not borrowed money from any third party to disburse the loan(s). The Company will assist in ensuring that the EMI reaches my designated bank account from the borrower(s)’ account.
9. I can access and procure information and material directly from the borrower(s) as needed, and I can research, verify, and arrive at a judgment myself. The Company does not need to perform any such obligation for me. I shall keep the Company indemnified against any losses.
10. I authorize the Company to retain the cheques provided as collateral by the borrower(s) and present them to me if the borrower(s) are unable to meet their repayment obligations. The Company has no responsibility for the recovery of the loan(s).
11. The Company may send reminders to the borrower(s) regarding monthly due dates.
12. The Company may send reminders to the borrower(s) in the event of a delay in loan repayment.
13. The Company may send a legal notice to the defaulting borrower(s) after a delay in loan repayment and hand over the cheques provided as collateral.
14. The Company may inform the recovery agency after a delay in loan repayment for collection procedures. The charges for the recovery agency will be incurred by myself.
15. I confirm that I do not have over ₹50,00,000 invested or lent across all P2P Lending platforms and will not exceed this limit on Lendbox. I will inform the Company if the said limit is exceeded.
16. I confirm that I have not invested or lent over ₹50,000 to a single borrower across all P2P Lending platforms and will not exceed this limit on Lendbox. I will inform the Company if the said limit is exceeded.
17. “Per Annum by Lendbox” refers to the services provided by the Lendbox platform on its investment platform called “Per Annum by Lendbox.”
18. By adding funds to the “Per Annum by Lendbox” platform, I give Lendbox authorization to automatically invest my funds in different borrowers from the Per Annum platform. This investment is based on Lendbox’s algorithm, and they will continue reinvesting repayments in new borrowers to optimize my returns. No further signature, consent, or authorization is required from me for lending to borrowers on the Per Annum by Lendbox platform. However, I will receive a signed copy (in PDF) of the loan agreement for each borrower my funds are invested in.
19. I agree and understand the following terms and conditions for the Fixed Tenure Investment Product on the Per Annum by Lendbox platform:  – The minimum deposit amount is Rs 100,000.

    – My investment will be locked-in for a minimum tenure of one year from the date of deposit, which will be determined at the time of locking-in the funds.

    – I can make multiple deposits, and each deposit will be individually locked-in for one year from the date of deposit.

    – During the lock-in tenure, I cannot withdraw the principal amount of the investment until the end of the decided tenure. However, I can choose to withdraw the interest earnings on a monthly basis.

    – Deposited funds will start earning interest from the day after the deposit, subject to bank holidays and the availability of new loans on the Per Annum by Lendbox platform.

    – Lendbox charges a 1% investment fee on the deposit amount.

    – At the end of the tenure, my principal amount will be returned after selling all active loans in a secondary sale, depending on the availability of such secondary sales.

20. I agree and understand the following terms and conditions for the Flexi Investment Product on the Per Annum by Lendbox platform:  – The minimum deposit amount is Rs 50,000.

    – I can make multiple deposits.

    – Deposited funds will start earning interest from the day after the deposit, subject to bank holidays and the availability of new loans on the Per Annum by Lendbox platform.

    – I can place a withdrawal request anytime after three working days from the date of deposit.

    – Lendbox will facilitate the withdrawal of my investment by selling all active loans in a secondary sale, depending on the availability of such secondary sales or funds.

    – The withdrawal amount will be credited to my bank account within three working days, subject to bank holidays.

21. I understand and agree that any interest amount and other charges paid by the borrower, beyond my committed investment returns, may be charged by Lendbox and/or the partner company as service/facilitation/collection/miscellaneous fees.
22. I declare that I have provided this undertaking and declaration of my own free will and upon fully reading and understanding the material terms and conditions available on the website of the company. I confirm that this declaration and undertaking were not obtained under coercion or duress.
